After being found guilty of involuntary manslaughter in court in Miami, Florida, the Mexican actor paul lyle is waiting for the judge, Marisa Tinkler Mendez, to issue a sentence on October 26.
However, before this happens, a legal remedy in force in the state of Florida could be the last hope. for the actor to reach a lesser sentence, since it was not a malicious crime and Lyle has no criminal record.
For now, it is said that the sentence that Lyle could face is estimated between 9.5 to 15 years in prison, this being the maximum penalty, which was proposed by the prosecution the day the verdict was exposed.
The legal remedy known as incentive gain time could be applicable to the actor, since, during the process, Lyle has adhered to all the relevant protocols, so he would be a candidate for a 15% reduction in his sentence, therefore, he would only have to serve 85% of his sentence.
As mandated by the Florida Department of Corrections, Incentive earning time is applicable to inmates who committed a felony after October 1, 1995 and these are not violent, then the sentence could be reduced by several days per month, depending on the case.
It is important to mention that this resource requests that inmates have good behavior, community work and also for participation in social reintegration programs.. Although, in Lyle’s chaos, the three years he spent on house arrest wouldn’t count toward reducing his sentence.
Everything seems to indicate that Lyle will be sentenced to the maximum penalty, which is 15 years in prison, although the final decision is pending. Meanwhile, the actor was transferred to the El Doral Correctional Center, located near the Miami airport, waiting to be placed in a state prison as soon as the details of the sentence are known..
?We always believed that our victim, Juan Ricardo Hernández, succumbed to the blow given by Mr. Lyle, therefore, my office filed a charge of involuntary manslaughter against Pablo Lyle?expressed the prosecutor in charge of the Katherine Fernández case, during an interview granted to the television program El Gordo y la Flaca.
Regarding the sentence that will be issued to Lyle soon, the prosecutor reported that she hopes that the sentence will be adjusted, so that both the actor’s family and the victim’s family will be discussed.
