The independent public audiovisual authority has just announced Tuesday, April 11 the formal notice of three new pornographic sites and requests the blocking of two others in France. A sign of impatience from Arcom, still awaiting the government’s age verification device.<\/p>\n

After the threats, the French public authorities went on the attack: in a press release published on Tuesday April 11, 2023, the Regulatory Authority for Audiovisual and Digital Communication (Arcom) announced the formal notice of three new pornographic sites. The audiovisual police accuse them of not sufficiently preventing underage Internet users from accessing their content, which is legally reserved for adults.<\/p>\n

Arcom asks HeurePorno (.com), FoliePorno (.fr), and xHamsterLive (.com) to install an age control solution stronger than a simple disclaimer “I am over 18”.
If there is no response within 15 days, the authority may initiate an access blocking procedure.

Arcom had already pronounced the same sentence in April 2022 against two other very popular free platforms, YouPorn and RedTube. In the absence of changes, the authority therefore requests in its press release their total blocking in France. A first.<\/p>\n

A two-step procedure<\/h2>\n

Since July 2020, the law allows this independent public entity to request the blocking by justice of pornographic sites which do not sufficiently verify the legal minimum age of 18 years of their Internet users. A two-step process, illustrated by recent announcements.<\/p>\n

1st step: formal notice<\/h3>\n

First, Arcom issues a formal notice to the online platform concerned, asking it to enforce this ban on minors within 15 days. This is what is happening today for three sites: xHamsterLive, Heureporno and Folieporno.<\/p>\n

In the first two cases, accessing their pornographic content \u201cresults from a simple declaration of majority on which it is enough to click<\/em>\u201c, argues the audiovisual policeman in his decisions. For the third, there is not even a banner displayed.<\/p>\n

2nd step: blocking the site<\/h3>\n

Once the 15-day period has expired, if Arcom considers that the pornographic content is made accessible to minors, it can seize the Paris court to request the delisting of the site on search engines on the French Internet and\/ or its total blockage with the main Internet service providers (ISPs).<\/p>\n

The same day, Arcom announces that it is taking legal action to order this time the blocking of the MGFreeSites sites, namely YouPorn (.com) and RedTube (.com). Both sites still limit themselves to an age disclaimer despite the injunction.

So this is what is happening today for YouPorn and RedTube, two entities owned by the porn giant MindGeek already served formal notice in 2022 for the same reasons as the others. This is the first time that Arcom has completed this process.<\/p>\n

Verify age, but don’t know how<\/h2>\n

On the other hand, 5 other sites had already been pinned by the audiovisual gendarme, at the end of 2021, without them changing their methods of controlling the majority of their visitors.<\/p>\n

Despite the total lack of effort by these platforms, the age verification of Internet users requested by the public authorities does not yet exist. If the government announced at the beginning of February 2023 that it was going to test a new device from the end of March, we have no news of this tool for the moment.<\/p>\n

A still vague method which should concern both Twitter and Pornhub, but whose implementation by facial recognition or credit card could be more complicated than expected.<\/p>\n\n
