The Animal Welfare Law is a powder keg of controversy, from the dog owner course to the differentiation of domestic and breed dogs that has sparked the #MismoPerroMismaLey movement. Now he’s grabbing headlines again for the fine that could be imposed if you leave your dog on the terrace, balcony or patiowhich has been tinged with hoaxes and fake news.
The draft of the Animal Welfare Law says in its Article 32 that “animals cannot be kept permanently on terraces, balconies, roof terraces, storage rooms, basements, patios and similar or vehicles.” However, it does not specify more than “permanently”, implying that it refers to the pets that live in those spaces without clarifying it concisely.

This ban is nothing new.
This lack of clarity is the perfect breeding ground for hoaxes and exaggerations, which many sectors that want to abolish this law before making it official have taken advantage of in their favor. Thus, the Internet has been filled with headlines about this ban, which can reach fines of 10,000 euros. But beware, because it is not a new law and it already existed at regional level.
For example, in the Community of Madrid there is It is forbidden to have animals tied up or confined in conditions of suffering. and isolation. It is also not allowed to have them on terraces and patios at night. The same is considered animal abuse in places like Castilla La Mancha, Castilla y León, Andalusia and Catalonia.

The only thing that changes with the preliminary draft of the Animal Welfare Law is the amount of the fine, which was previously penalized with 150-300 euros and can now be reach 15,000 euros in very extreme situations of animal abuse, due to the reinforcement that the Government wants to put in the protection of our animals.
