The abandonment of home by parents towards their children is something so common that in many families it is already normal, so it is not surprising that they stop having contact with them, disregard their upbringing and, above all, maintenance.
In many cases, the mother raises her children without anyone’s support, although there are exceptions of women who remarry and manage to raise their children with the help of that new man.
However, something that is not at all common is that children reject their father’s last name and replace it with that of their mother’s current husband. Just like this pair of brothers, who after being abandoned by their biological father, wanted to honor their stepfather’s name and carry his last name.
Based on international laws on Human Rights such as the Universal Declaration and under the argument of having had an absent father who was never involved in their upbringing, two brothers filed a lawsuit in the State of Mexico to modify their birth certificate and remove their last name. of his parent.
My father was never involved in taking care of us or providing money for food, education and housing.
Although the authorities of the Judicial Power of the State of Mexico assured that the change of surname through a trial is something uncommon in the entity, both brothers achieved it and a family judge issued a sentence so that they could modify their paternal surname and change it to that of the mother. his mother’s partner.
Assuming that the fundamental right of a name in terms of personality is linked to a person’s identity, the judge gave them the opportunity to let them bear the surname of the man who has really been a father figure in their lives and through the Civil Registry Office , where the documents were originally settled, the requested changes were made according to what was requested by the children and parents in question.
